Terms and Conditions

1. Agreement to Terms

By accessing or using Arcus ("the Service"), operated by Agentic Leisure ("we", "us", "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service. These terms are governed by the laws of the Province of Ontario, Canada.

2. Description of Service

Arcus is an AI-powered hospitality operations platform that provides operations forecasts, staff scheduling recommendations, and management briefs for hotels, spas, event venues, and other hospitality businesses. The Service uses artificial intelligence to generate recommendations based on data you provide.

3. AI-Generated Content Disclaimer

All forecasts, briefs, staff schedules, and recommendations generated by Arcus are produced by artificial intelligence and are provided for informational and planning purposes only. By using the Service you acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or omissions
  • Forecasts are estimates based on historical data and are not guarantees of future performance
  • All operational decisions remain the sole responsibility of you and your management team
  • Agentic Leisure is not liable for any business decisions made based on AI-generated content
  • You should always apply your own professional judgment before acting on any recommendation

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You must be at least 18 years of age to use the Service.

5. Forecast Credits and Payment

The Service operates on a credit-based system. Forecast credits must be purchased in advance to generate operations briefs. By purchasing credits you agree to the following:

  • Credits are purchased in packs at the prices displayed at time of purchase
  • Credits do not expire and remain in your account until used
  • One credit is deducted each time you successfully generate a new operations brief
  • Viewing previously saved briefs does not consume credits
  • All prices are displayed in United States Dollars (USD)
  • Payments are processed securely by Stripe and are subject to Stripe's terms of service

6. No Refund Policy

All purchases of forecast credits are final and non-refundable. By completing a purchase you acknowledge and agree that:

  • No refunds will be issued for purchased credits under any circumstances
  • No refunds will be issued for partially used credit packs
  • No refunds will be issued if you choose to stop using the Service
  • No refunds will be issued for credits consumed by forecasts you are unsatisfied with

If you experience a technical error that prevents a forecast from completing but still deducts a credit, please contact us at support@agenticleisure.com and we will review the case at our discretion.

7. Your Data

You retain ownership of all data you import into Arcus including booking history, staff profiles, menu items, and services. By uploading data to the Service you grant Agentic Leisure a limited licence to process that data solely for the purpose of generating your operations forecasts. We do not sell, share, or use your business data for any other purpose. See our Privacy Policy for full details.

8. Acceptable Use

You agree not to use the Service to:

  • Upload false, misleading, or fraudulent data
  • Attempt to reverse engineer, copy, or replicate the Service
  • Resell or sublicence access to the Service without written permission
  • Interfere with or disrupt the Service or its infrastructure
  • Violate any applicable laws or regulations

9. Service Availability

We aim to maintain continuous availability of the Service but do not guarantee uninterrupted access. We reserve the right to perform maintenance, updates, or modifications at any time. We are not liable for any losses resulting from Service downtime or interruptions.

10. Limitation of Liability

To the maximum extent permitted by Ontario law, Agentic Leisure shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost revenue, lost profits, or business interruption, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for credits in the three months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms. Upon termination your remaining credits are forfeited and no refund will be issued. You may close your account at any time by contacting us.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
